What is needed for legitimizing an arbitrary building in the end? As written in a popular greek newspaper on 02/12/2015, an extension for legitimizing an arbitrary building was announced. The extension will be given as long as it is deemed necessary… It is expected development, after the Council of State’s decision, which dismissed the appeals against the constitutionality of the law. In the new long list of amendments tabled in the “eleventh hour” of the enactment of the law, is contained numerous small and large changes of urban and forest law.
Specifically, the law:
- provides that the deadlines of law 4178/13 for arbitrary buildings, which according to the last two PEKA ministers, would be set in February 2015, can be postponed.
- provides for the creation of a “Central Inspection Council”, which will be under the Minister of Environment and with the participation of officials and other involved ministries, and which will be able to interfere with the inspectors’ work, before fines are charged or upon application by the aggrieved.
- allows the development of gas and electricity networks in reforested areas (ie burnt).
- provides for the simultaneous issue of demolition and new building permits for large buildings.
- extends by one year the issue of licenses that abide with the old building regulation.
- allows for exceedances in the construction of processing facilities of agricultural products in small settlements.
- further facilitates construction for building in ‘blind’ plots.
- decreases the basic fines for water pollution.
Generally speaking, a statutory declaration from the owner and a certificate from a mechanic, stating that there is no arbitrary construction or that the property was subject to the arbitrary settlement act, are needed for legitimizing an arbitrary building.
The procedure for legitimizing an arbitrary building consists of:
- Assigning a mechanic with checking the structure
- Electronic submission of the application
- Payment of the fine
- Collecting the required information
- Submitting the required information from the mechanic in the system, while issuing the CERTIFICATE OF THE ARBITRARY BUILDING’S REGULATION .
Fines for arbitrary buildings are calculated as follows:
Square meters x area’s value X 15% X factors
Finally, some of the elements affecting the fine for an arbitrary building are the following: The existence of a building permit, the type of use, the area of the arbitrary building, the exceedance of the building, the age etc.
